Sentencing postponed for man who killed ex-girlfriend

The sentencing for a man convicted of killing his ex-girlfriend, Lindsay Ann Burke, in a jealous rage has been postponed from today until April 12.

Gerardo E. Martinez, the 29-year-old Warwick man Burke dated for two years, will be sentenced in Kent County Courthouse by Superior Court Judge Francis J. Darigan Jr.

A Superior Court jury convicted Martinez in January. The state is seeking life in prison without the possibility of parole for Martinez.

Martinez murdered Burke, 23, on Sept. 14, 2005, after discovering the photo of another man in her purse. Burke had broken up with Martinez by then.

A Web site created in Burke’s memory offers more details about Burke, domestic violence, the Lindsay Ann Burke Act, which is supported by the state’s Attorney General Patrick C. Lynch, and where to go for help if you are in a violent relationship.

In his anger, Martinez broke Burke’s nose, stabbed her multiple times in the head and chest, and slashed her throat with a 6-inch knife, depositing her bloodied body in the bathtub of his Warwick apartment.

In the seven-day trial, prosecutors saved their most compelling evidence for the final day of testimony, when they played a six-minute homemade videotape in which Martinez, on the day of the murder, confesses to the killing and begs forgiveness from his parents and son, Enrique.

Burke’s parents have worked in the two years since her murder encouraging high school students to talk openly about unhealthy relationships. Now, if a bill named for Burke becomes law, public school districts across the state would be required to teach middle and high school students about dating violence.

A murderer like this should be allowed to have the death penalty.......What he did to that woman..... They should lock him up with only the family members with him and allow them to do to him....what he did to that poor girl......The death penalty.....life without chance of parole.....You kill someone...you SHOULD be killed the way that you killed them.......AND THAT'S IT!!!!!!!!!!! We are way too easy on these killers....And this guy.....BIG MAn beating up a girl.......Put a knife to his throat and slash it and watch him die.....

The memorial site to Ms Burke is impressive. Everyone who has a heart should follow the link "what you can do" and write each member of Congress listed. While it takes only a few seconds to copy and paste the information into an email to send to the Congressional members listed, the hearts of those who loved her and knew her will always long for the life that this savage abuser has taken from them. Abuse takes many forms and the only way to stop it is to step up and speak out...will you?

WELL IF IT WAS YOUR FAMILY MEMBER THAT KILLED SOMEONE THAT WAY. WOULD YOU REALLY WANT SOMEONE TO KILL HIM THE WAY HE KILLED THAT PERSON. OF COURSE NOT BECAUSE NO ONE WANTS TO SEE ONE OF THEIR OWN STUMBLE AND FALL. No one knows what occured that day, that is the point that has to be gotten accross, what everyone hears on the news and what not are only SPECULATIONS, the family of the murderer feels pain as well, I don't see why people assume that they aren't compelled by what occured. NO ONE DESERVES TO DIE! NOT EVEN THOSE WHO KILL BECAUSE GUILT THE GUILT IS WHAT WILL SLOWLY KILL THEM INSIDE REGARDLESS! Unfortunantly EVERYONE has to live with the fact that this poor girl died, Especially the man who killed her & it's just so sad that this had to occur.

All I gotta say is if it was any of your family members in that postion damn straight everyone would be like OMG! MY RELATIVE, I DON'T WANT NO DEATH PENALTY FOR HIM/HER OR LIFE WITHOUT POSSIBILITY OF PAROLE... so I suggest everyone writing comments stating that he should be killed, needs to really think and put yourself in the position of the Martinez family. & you'll see what they are possibly feeling as well. Because the Burke's are not the only one's suffering for thier daughters death, the others are suffering as well. SO Quit your death speaking, US safety talking becuase Damn Straight you all would feel hurt if it was your relative that was in jail!!! >=/

Instead of the death penalty, I'm a proponent for the "lock 'em up and throw away the key" punishment (and I mean that literally). Lock him up; slide a bowl of gruel under the door twice a day.

ARE YOU KIDDING ME? this man needs to be locked up for life..i know lindsay's father..he is one of my teachers..after reading this i was shocked and sickened by the things he had to go through.oh and to the pepople who say that its not fair that their family member has to be locked up you are sick. just reading this article makes me sick to my stomach. my condolences to the burke family.
