Update: Sen. Whitehouse questions, praises Sotomayor

WASHINGTON, D.C. -- Sen. Sheldon Whitehouse warmly praised Judge Sonia Sotomayor Wednesday as President Obama's nominee to the U.S. Supreme Court faced a second day of questioning from members of the Senate Judiciary Committee.

"It actually gives me goose bumps to think about the path that has brought you here today'' and what it says about the nation, Rhode Island Democrat Whitehouse said early in his exchange with the federal appeals court judge.

Whitehouse elicited from Sotomayor a pledge to decide cases before her on the facts, to respect the role of Congress in making the law, to avoid prejudging cases and to respect precedents set by previous court rulings.

The former state attorney general and U.S. attorney also praised Sotomayor as a fellow former prosecutor, saying that her choice of that line of public service early in her career "merits a salute.''

The Judiciary committee resumed its consideration of Sotomayor nomination to the U.S. Supreme Court Wednesday morning.

The panel's Democratic chairman, Sen. Patrick J. Leahy of Vermont, gaveled the panel to order this morning for the third day of hearings on whether the Senate should confirm President Obama's nomination of the New York federal appeals court judge to the high court. On tap are question-and-answer sessions for the junior committee members, including Whitehouse, who have not yet had their exchanges with the nominee.

During this first round of questioning, each senator gets 30 minutes to question Sotomayor.

Please ask the judge if a white man is better able to question a wise Latina than is a black man... and then pack your bags and come home because you would pay a huge price career-wise for such a racist, sexist comment. Ask the judge if a white male litigant has ever stood before her and argued that he could make a better decision than could a wise Latina. Consider what her response would have been to such a racist, sexist comment. If a white male was a candidate for the US Supreme Court, and he had ever made such a racist, sexist comment... well, he most certainly would not be confirmed by the US Congress. This judge should simply be held to the same standards to which you would hold a white male candidate- or any other candidate. Justice is supposed to be blind. Judge Sotomayor has made it known that she is not "blind". This is a big problem and a precursor of her decisions to come. This is not some subtle flaw that is difficult to discern at this threshold time, it is a glaring, overt fault of Judge Sotomayor's that she has clearly broadcast - she has an agenda and she has so much as said what the agenda is. Even though some may want to see a female Hispanic appointed to the US Supreme Court right now, someone needs to be brave enough to make it clear that he/she cannot vote to confirm a judge who has made such an overtly sexist, racist comment in the past. Period. The flip side of the question is, "How can anyone vote to confirm a judge who would say something like this?"

I think Whitehouse will stick to his baseball theme and ask for an autographed gavel. His questions will reflect the tenacity he showed as US Attorney and Attorney General. No doubt he will dig deep and resolve any issues he may have with the candidate's record.
Not. He never has issues with Party members and their candidates.
Actually I must admit, most if not all senators march to the orders from above so Sheldon is not alone here, he is just particularly smarmy and offensive in his manner. Remember when he left Edwards and Angell he warned us that he was "bred to lead". This will not be "must see TV".

She hasn't appeared very empathetic to me. I thought Obama didn't want a strict constructionist who would adhere to the law, but a Justice who makes decisions based on empathy for the parties involved.

The comment is about the triumph of minorities, not racism. If you actually read the comment and see who she was addressing she is comparing a wise, latina woman will come out better than a white man WITHOUT any of that wisdom. In other words...someone with wisdom and experience will succeed over someone without any. The reason behind her wording is a reflection of the racist history of unwise, inexperienced white men succeeding for no other reason than their color. Of course people hear what they want to hear and read what they want to read...so I wonder if there is any chance at all of people these days actually reading to try to understand and not just repeating what someone else says based on their feelings.

Whitehouse sounds like a teenaged girl with a crush on the Jonas Brothers....if he asks Sotomayor a tough question it will be a big first. Pod used the word "smarmy" to describe him...I looked it up and sure enough, Sheldon's picture is there in the dictionary with the definition!!

Whitehouse's sycophantic behavior is embarassing. He is nothing more than a puppet for the Democrats and has never had an original thought in his life. The fact that Rhode Island elected this clown doesn't say much for the intelligence in this state.

What a pathetic group of congressmen we have in this state. Can anyone think of one thing they have accomplished, not worked on, accomplished? They didn't even read the bills they passed, the bailouts, the stimulus, the health care, they have no idea what is in it, and they say they are looking out for us. The problem is, Rhode Islanders buy it. Maybe it's not a pathetic group of congressmen, maybe it's a pathetic group people.

Kudos to Senator Whitehouse for a job well done. He very much distinguished himself as judged by the many comments on his performance by knowledgeable people in the national media. All Rhode Islanders can be proud that a small state like this is represented by such a distinguished person. Many of the Republican Senators paled in comparison to the erudition show by Whitehouse.!!!

I sent the esteemed Sen a note about my concerns about this candidate and advocated that he buck the party line. He responded how impressed he was with her record and how excited he was to participate in the confirmation process. The only thing missing was a Yes We Can logo. We pay for it.
