A bill to require that banks notify tenants about a pending foreclosure sale and continue to provide "essential services" such as heat, water and utilities passed the Senate Thursday night. The bill (S-40), introduced by Sen. Juan M. Pichardo, D-Providence, now must go before the House for a vote. The bill requires that prior to a foreclosure sale, the bank continue to provide the same hot and cold running water, heat and utility services that were previously provided by the landlord. Payment for those services would continue according to the prior rental agreement. The bill also requires that banks send written notices to tenants alerting them that the property is scheduled to be sold at auction, and include information about government-certified housing counselors and a toll-free number for them to contact. Once a foreclosure sale occurs, the bank also must give tenants 30 days notice prior to being ordered to move out. |
