PROVIDENCE, R.I. -- A Superior Court judge has denied Nicholas Gianquitti's bid for a new trial following his murder conviction in the shooting death of his neighbor James A. Pagano, a 44-year-old Cranston fire lieutenant. Judge Robert D. Krause denied the request Tuesday morning, ruling that the testimony in support of Gianquitti's conviction was convincing. Judge Krause also set sentencing for June 25. Defense lawyer William Devine said Gianquitti would appeal to the state Supreme Court. Gianquitti's lawyers had argued that he should be granted a new trial because of conflicts in some of the testimony. Gianquitti, who served briefly as a Providence police officer, was convicted April 1 of second-degree murder for the shooting of his neighbor during an argument over a stray tennis ball. -- reported by Katie Mulvaney, Journal staff writer |
