PROVIDENCE, R.I. -- Alec Totten was sitting on his couch watching television at his Cranston home of 27 Daisy Court when he heard "a loud male voice" outside, the 12-year-old testified Wednesday afternoon in the murder trial of his neighbor, Nicholas Gianquitti. Alec -- who stood as he testified in order to reach the microphone -- said he looked out the window, across the street from Gianquitti's house, and saw James Pagano running out of Nicholas Gianquitti's house. Gianquitti is accused of shooting Pagano, his next-door neighbor, to death in a dispute that began when a child's stray tennis ball struck Gianquitti's car on May 18, 2008. Moments later, Alec said in his testimony, Gianquitti came out, pistol in hand. "I heard a gunshot," Alec said, crying. "He was holding it straight at him," he continued as he composed himself. "At whom?" asked Assistant Attorney General William Ferland, who is prosecuting the case. "Mr. Pagano," he said. He said he told his older brother what was happening and his brother, Ryan, ran down to help James Pagano. He fell on the ground. At some point, Alec said, Gianquitti "just walked in the house."
