Smith hears arguments in Tiverton soil contamination case

PROVIDENCE _ A complex soil contamination case in North Tiverton boiled down to who said what to whom and whether all the words added up to a settlement during legal arguments this morning.
U.S. District Court Judge William E. Smith this morning heard from lawyers for about 150 North Tiverton residents who are seeking a court order to enforce the terms of a $12 million deal they said was struck last April with the Texas-based utility Southern Union, the defendant in a lawsuit they filed nearly four years ago.
Lawyers for Southern Union maintain the terms put on the court record last April 22 in a conference with Senior Judge Ernest C. Torres contained an "outline of a settlement," but there was no actual deal.
Smith took arguments from both sides under advisement and said he would make a decision "soon."
