Guatemalan charged in Providence rape in ICE custody

An alleged rapist who the Providence police say was on the lam for more than two years is now in the custody of federal authorities. The U.S. Bureau of Immigration and Customs Enforcement claims that he is in the country illegally.

Yobani Santos, 22, of 204 River Ave., Apt. 3, Providence, is a citizen of Guatemala and he has been charged with immigration violations, according to Paula Grenier, ICE spokeswoman. She would not disclose the specific charges but said that he has a hearing pending before an immigration judge.

Santos is charged with first-degree sexual assault against a 15-year-old girl in 2006, when Santos was 19 years old.

Maj. Thomas F. Oates III, commander of the Providence police Investigative Division, said the police were called to a house at 177 Harold St., in the Valley neighborhood, at 2 a.m. on Oct. 11, 2006. A woman at that address told the police, he said, that her stepson, Santos, had raped her daughter on Sept. 24.

On Dec. 14, 2006, the police obtained an arrest warrant that charged Santos with first-degree sexual assault. Santos knew the police were looking for him but he steered clear of arrest, Oates said.

That changed at 7:20 a.m. on Jan. 15, when, according to the state police, a trooper stopped a car that was he was driving on Route 146 and took him into custody on the Providence warrant.

After arraignment in District Court, Santos posted bail and was turned over to ICE.

Grenier, of ICE, said this week that her agency will make Santos available for criminal proceedings in the State of Rhode Island whenever a state judge signs a writ asking for him.
