Warwick family sues Verizon over Playboy transmissions

WARWICK -- A Warwick family is suing Verizon Communications, claiming that unauthorized transmissions of the Playboy Channel caused them "great pain, anxiety, nervousness and mental anguish."

In the suit, filed on Nov. 24 in Kent County Superior Court, Robert Bourne, Denise Roy, and their minor daughters, Elise Roy and Danielle Bourne, say Verizon, their cable provider, failed to stop "unauthorized transmissions" of the Playboy Channel despite being notified multiple times between March and August 2008.

The suit claims an invasion of privacy and says the content on the Playboy Channel includes "sexually explicit hardcore pornography" and "is patently offensive."

"The emotional distress suffered by the plaintiffs is so severe that no reasonable person could be expected to endure it , and the emotional distress has resulted in physical symptomatology of emotional distress," the suit claims.

The plaintiffs say they "have incurred and wil continue to incur expenses for hospital care, medical care and attention, medications, other materials and supplies."

The lawsuit does not request a specific amount of money.

I understand it was not blocked but why did we have to keep looking at it, if it was causing you pain and suffering. Almost like telling a kid not to touch the stove because it is hot and then doing it anyways.

And the problem with free porn is what? I have an answer: consider it a gift from the TV gods and pay attention to what your kids watch. Maybe you could even use the parental controls built into Fios.

What???? They couldn't change the channel in the interim period ??? Or shut the television off ??? Talk about frivilous lawsuits !! Any judge deciding in the plaintiffs' favor should think about retiring and saving the taxpayers of RI alot of money and embarrassment !

Oh please! I hope this gets dismissed and they are forced to pay court costs for such a waste of time. It is so easy to program a channel off your line up. The only way they could have been traumatized by these transmissions is if they were repeatedly tuning into that channel to see if indeed they could still get the playboy channel.

The fact that medical attention is now needed because they could not refrain from clicking on The Playboy Channel shows that something is not right here.

These people should be charged with fraud and embezzlement. No one hates Verizon more than me, but, I would pay their legal fees to fight this one if I could, These people are idiots.

i work for verizon and somebody in that residence kept ordering the channel through the box. need to take control of your children.
