No ruling yet from judge on health-insurance dispute

PROVIDENCE -- Superior Court Judge Patricia A. Hurst made no ruling this afternoon after meeting for about an hour behind closed doors with lawyers for Governor Carcieri and Council 94 -- the two sides in a health-insurance contract disagreement.

Those who attended today refused to comment on what happened as they left the meeting.

The sides met last week with the judge as well.

Council 94 has sought to have the judge put off a ruling that could compel thousands of state workers who are union members to pay more for health insurance.

Carcieri has said the state could save $10 million through the various health-insurance changes.

Hurst last week ruled the governor could carry out his executive order raising health insurance costs for state employees in the executive branch, but that constitutional provisions barred Carcieri from raising insurance costs for employees in other state goverment branches.

Hurst last week told Council 94, of the American Federation of State County and Municipal Employees, that it was up to the state Labor Relations Board, not the courts, to decide whether the governor can compel executive branch workers to pay higher health-care costs.

The Lady Judge needs to stop pondering and make a decision that supports our Governor Carcieri 100% in meeting his obligation to ALL the citizens of The State of Rhode Island. That is our Governor needs the entire State Government unit to fall in behind him following his leadership. The team can only have one coach, one quarterback and the referees must understand the rules of the game being played. All parties have roles and responsibilities that must result in constructive and necessary reform e.g. team work.

Clearly reform of our state government and restoring fiscal responsibility has been neglated for many generations. This finical calamity has hobbled The State of Rhode Island in a transition to s global economy. The state Unions must be transitioned to the realism to a realistic market based pay and benefits. Moreover work to increase their productivity and creativity. The stalling tactics and strategy practiced for many years is not in their best interest or all citizens interest. Again not in the best interest of the citizens of RI. Lady Judge, General Assembly and Union members ALL - it is time to strand up and be counted for the state of RI Citizens. That is to support the Governors budget shortfall closure efforts and Government operational reforms of all kinds. Yes including the adjustment of union pay and benefits, Across ALL State of RI Unions and or direct employees. This reform mist ultimately must be accepted.
The game is almost over and the time to follow your quarterback is now.

This is the type of nonsense we have to put up with because the head business agent for Council 94 is Senator Tassoni, the "poster-boy" for conflict-of-interest. Only in RI would we have a Union employee on the Labor Committee in the Senate. He represents the Union at the General Assembly, not the taxpayers in Smithfield and North Smithfield!!

Mr. Horan seems to have forgotten that we have three separate branches of government under the CONSTITUTION, not a king. The Judiciary is not under the control of the Executive, not the Legislative branch. The Governor has ignored the General Laws of Rhode Island. He truly is a lame duck, not a quarterback. If he was the quarterback, he would have been put on waivers long ago for not producing. Judge Hurst is not on the Governor's payroll (thank God) and will make due diliberations. The budget enacted was based on chewing gum, wishful projections and the continued failed promises of the Governor and his "TEAM". The State Labor Board is the next step for Council 94 and the King Don as provided for under THE LAW. We all know what happens when you ASSUME. The Governor and the not co-paying General Assembly assumed too much. If Mr Horan feels so strongly, he should have run for General Assembly to try and get his collegues in the House or Senate to join his DREAM TEAM. If Mr. Horan were to break the law, he would not be above the Laws of Rhode Island or the United States of America. Citizen Carcieri is not better, nor except from following the laws. Perhaps he should stop threats and start negotiating.

Billy, the job of the "Lady Judge" is not to support anything but the law, and her tenure on the bench makes her an expert on the interpretation of the law. You're trying to turn a separate branch of the government into a cheerleader for an emperor. We don't do it that way in America.

Well now lets see if everyone in this wonderful state of RI gave up a days pay to help with the budget then I am all for it... Since we have had Carcieri in there and the great business man that he is has been allowed to flush RI right down the toilet!!!!So send in your checks today to help balance the budget since he cant seem to do it after almost 8 long years!!!!!!!NOW HOW SILLY DOES THAT SOUND!!!!!! See it sounds silly when the shoe is on the other foot....In this great country no one works for free!!!!!!! Why should I.....when the checks start rolling in count me in....it is not my job or any other co-worker of mine to balance the STATE BUDGET!!!!!!! He is not god nor a king......so the quicker we get rid of him the better all of us will be AHEM

Sue - The Governor is only responsible for proposing a balanced budget. It is the general ASSembly that passes the budget. They are the ones who increase spending and fill holes with one time mioney like the tobacco settlement. Don Carcieri is the first Governor who has actually tried to curb spending. All us taxpayers do in effect work days for free to make up for the extra taxes we have to pay. 8% of the Health Care premium for lower paid workers is not a hardship.
